QUESTION: Just wondering, if one pleads Not Guilty is the issuing officer required to attend the hearing? Would this be overtime on his/her time off or overtime to someone to fill in on their shift?
ANSWER: That is possible. If you plead not guilty to an infractions complaint, the plea goes to the Centralized Infractions Bureau and is reviewed by someone from the Chief State's Attorney's office. After they review your plea, if they decide to go ahead with a trial, you will be notified of the hearing date and the officer will receive a subpoena to appear in court to testify on behalf of the state. If it is his day off, then he would most likely receive overtime.
The police chief is correct, state law requires there to be an appeal process for municipal parking fines in order for them to be collectible.
