WASHINGTON D.C. - The U.S. Senate will call two New Haven fire fighters to testify at the confirmation hearings of Judge Sonia Sotomayor, making clear the Judiciary Committee intents to place affirmative action at the center of the Senate battle over Judge Sotomayor's nomination.
A Judiciary Committee posting lists Frank Ricci and Ben Vargas as expected Judiciary Committee witnesses. Fireman Ricci was the lead plaintiff in Ricci v. DeStefano, the controversial case in which Judge Sotomayor ruled the City of New Haven CT acted constitutionally when it discounted the results of a qualifying test for promotions after too few black firefighters scored as high as their white counterparts.
Fireman Vargas, who is Hispanic, was the only non-white co-plaintiff in the racially charged case.
The U.S. Supreme Court later overturned the decision of Judge Sonia Sotomayor that City of New Haven CT acted constitutionally in case of in Ricci v. DeStefano.
Washington D.C.- Being out of power can do wonders for a political party. Voters have now witnessed 2 1/2 years of Democratic control over Congress and six months of total control in Washington, and they don't much like what they see.
As a result, the Rasmussen survey now finds that likely voters trust Republicans more than Democrats on eight out of ten key issues, including a 46-41 margin on the economy and 52-36 on taxes.
If these trends continue, we may see the beginning of a Republican comeback in 2010 on the national level.

I appreciate what the mayor is trying to do, but I believe it will be difficult to undo the damage that Tim O'Brien, Phil Sherwood and their cronies caused with their racism demonstrations against this company.
It would be a lot like trying to undue the damage that Sotomayor caused in the New Haven fire fighter case.

Judge Sotomayor has no business being a candidate for the Supreme Court. She bases her judical decisions on what's fair - or what she "feels" is fair.
We thought judges were suppose to base their decisions on the law.
